§ 70-103. Oversize, overweight vehicles.

  • (a)

    No commercial motor vehicle may be driven, occupied or proceed on a through trip upon any city street or roadway except in accordance with a permit issued by the chief of police and approved by the city manager. However, this section shall not prohibit the temporary movement of school buses, emergency vehicles, fire and police vehicles, or public or private utility vehicles, service, maintenance or construction vehicles, and permitted vehicles from utilizing city streets.

    (b)

    Any person who violates subsection 70-103(a) above shall pay a fine of $100.00 for a first offense and $200.00 for each subsequent offense, and said fine shall not be in lieu of any and all other remedies permitted by Code of Ordinances or state law.

    (c)

    The city will not enforce the prohibitions of this section for a period of 60 days after the effective date of the ordinance that amended this section.

    (d)

    The city manager, or designee, is hereby authorized to post signs stating "Through Commercial Motor Vehicles Prohibited," or similar message, in such locations as to provide reasonable notice of this section.

    (e)

    Operators of tractor trailers shall not park the tractor, with or without the trailer, in a residential neighborhood.

    (f)

    Operators of commercial vehicles shall not park the commercial vehicle in a residential neighborhood.

    (g)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    (1)

    Commercial motor vehicle means any self-propelled or towed vehicle used on the public highways or roadways in commerce to transport passengers or cargo, if such vehicle:

    a.

    Has a gross vehicle weight rating of 10,000 pounds or more; for example, flatbed and stake truck, dump trucks, concrete trucks, fuel trucks, tractor trailer (single or double) beverage delivery, and others;

    b.

    Is designed to transport more than 15 passengers, including the driver; or

    c.

    Is used in the transportation of materials found to be hazardous for the purposes of the Hazardous Materials Transportation Act, as amended (49 U.S.C. ss. 1801 et seq.).

    (2)

    City street or roadway means any street or road within the city limits of the City of Quincy, except for any road designated and numbered as a state road. Note: King Street between the intersection of Lillian Springs Road and the intersection with SR 269 (Quincy bypass) has been transferred by the FDOT to the city and is no longer a state road.

    (3)

    Through trip means any driving or operation of a motor vehicle in the city without a local destination or point of origin within the city limits.
