§ 70-89.2. Multiple violations: increased fines and penalties; notification of state department of highway safety and motor vehicles.

  • When any vehicle has on at least three occasions within the preceding 18 months been found in violation of the parking ordinances of the city and the owner or operator thereof has failed to pay the fines therefor, the fines shall be increased an additional $5.00 dollars per offense; but in no instance shall the fine per offense be more than $30.00 dollars. The city shall notify the registered or titled owner thereof, by mail to the address given on the motor vehicle registration of the ticket, of the issuance of multiple violations for which notice has been given, and shall notify said owner that he may request a hearing before the city manager, or his designee, within ten days of mailing of said notice. Mailing of the notice to this address shall constitute adequate notification to the owner. Upon notification, the registered owner shall comply with the city's directive regarding payment of the parking tickets with the applicable increased fine amounts. If a hearing is requested, the same shall be held within seven days of the request therefor. The city manager, or his designee, may, upon good cause shown, modify the fines or extend the time within which the fines may be paid prior to notification of the State Department of Highway Safety and Motor Vehicles as described below:

    (1)

    In the event that payment is not received for the multiple violations according to the city's directive, or a hearing is not requested within the time period specified herein, the city shall forward the violator's name to the department of motor vehicles pursuant to F.S. § 316.1967 as set forth below.

    The city shall supply the State Department of Highway Safety and Motor Vehicles with a magnetically encoded computer tape reel or cartridge which is machine readable by the installed computer system at the department, listing persons who have three or more outstanding parking violations. Upon receiving such reel, the department shall mark the appropriate registration records of persons so reported, and no license plate or revalidation sticker shall be issued until such person's name no longer appears on said list or until he presents a receipt from the city showing that such parking fines have been paid or other satisfactory disposition has occurred.

    For the purpose of collecting multiple parking citations outstanding at the time of enactment, the provisions of this amending ordinance will be effective retroactively for 18 months prior to the date of enactment. Therefore, upon enactment, any violator who has been issued three or more parking citations within the 18-month period immediately preceding enactment, will receive notice of such infractions and the opportunity to pay all outstanding fines, or request a hearing regarding said fines, according to the same requirements as set forth above. Failure to pay the outstanding fines according to the city's directive or request a hearing within the time period specified above, will result in the violator's name being forwarded to the department of motor vehicles.
