§ 70-101. Parking in handicapped parking place.

  • (a)

    All parking spaces which are required by F.S. § 313.1955 or 316.1956 to be specifically designed and marked motor vehicle parking spaces for the exclusive use of those physically disabled persons who have been issued an exemption entitlement parking permit pursuant to F.S. § 316.1958 or 320.048, shall be prominently outlined with paint and posted with a permanent above-grade sign of a color and design approved by the Florida Department of Transportation, bearing the international symbol of accessibility, or both the international symbol of accessibility and the caption "PARKING BY DISABLED PERMIT ONLY".

    (b)

    It shall be unlawful for any person to stop, stand or park a vehicle within any parking place which is designated as handicapped parking, parking by disabled permit only, or disabled parking unless such vehicle displays a parking permit issued pursuant to the provisions of F.S. § 320.0848, and such vehicle is transporting a person eligible for the parking permit.

    (c)

    Nothing contained in this section shall prohibit the momentary parking in a handicapped parking space for the purpose of loading or unloading a disabled person, and no penalties shall be imposed upon the driver for such momentary parking.

    (d)

    (1)

    Any person who shall cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such person to be parked in violation of any of the provisions of this section shall be guilty of an infraction and shall be fined the amount of $200.00 for each offense if paid within seven days of the violation.

    (2)

    In addition to the fine and impoundment set forth herein, whenever a law enforcement officer finds a vehicle in violation of this section, that officer may have the unauthorized vehicle removed or require the operator or other person in charge thereof immediately to remove the unauthorized vehicle from the parking space.

    (e)

    Whenever any vehicle is removed by a law enforcement officer or the department of public safety or its designee, the cost of such removal and parking and the handicapped parking citation shall be a lien against the vehicle as provided in F.S. § 316.1955.

    (f)

    A motor vehicle displaying a special license plate or parking permit issued to a handicapped person by any other state or district license plate or permit allowing such vehicle the special parking privileges allowed in this section is exempted from the provisions of this section, provided such other state or district grants reciprocal recognition for handicapped residents of this state.
