§ 18-81. Admission and recordkeeping.

  • (a)

    Health examination and health maintenance.

    (1)

    Within 30 days of enrollment in a child care facility, each child must have a written statement on file from a licensed physician or authorized agent of a county health department in the state attesting that:

    a.

    The child is in good health or that any known irregular condition is under treatment.

    b.

    The child is free of tuberculosis as indicated by an approved skin test administered within the preceding six months.

    c.

    Immunizations appropriate to the child's age are up to date or are in the process of being brought up to date.

    (2)

    Immunization records must be kept current.

    (3)

    Written proof of physical examination must be filed with the facility every two years after the admission examination.

    (4)

    Any child shall be exempt from medical or physical examination or medical or surgical treatment upon written request of the parent of such child who objects to the examination and treatment; provided, however, that the laws, rules and regulations relating to contagious or communicable diseases and sanitary matters shall not be violated.

    (b)

    Enrollment information. The operator shall obtain and keep current the following enrollment information from the child's parent:

    (1)

    The child's full legal name, birth date, current address and preferred name.

    (2)

    The name and address of the parents.

    (3)

    Telephone numbers or instructions as to how the parents may be reached, during the hours the child is in the facility.

    (4)

    Names, addresses and telephone numbers of persons who can assume responsibility for the child if for some reason the parent cannot be reached immediately in an emergency.

    (5)

    Names and addresses of persons authorized to take the child from the child care facility.

    (6)

    The name, address and telephone number of a physician or health resource that can be called in case of emergency, and the parents written permission to consult that physician or health resource if the parent cannot be reached.

    (7)

    If the child's condition requires it, a written plan must be on file at the child care facility. This plan shall be developed on a cooperative effort between the child's parent, the operator and supervising physician or other specialists. This plan shall specify the handicapping condition and the special provisions which shall be made to meet the needs of the handicapped child.

    (8)

    The alternate nutrition plan written agreement to provide the bag lunch or the child's food shall be signed by the parent and kept on file.

    (c)

    Personnel records. Personnel records shall be maintained for the owner/operator, each employee of the facility, each regular volunteer and each household member in a child care facility being operated in a private house. These shall include:

    (1)

    Name, address and telephone number.

    (2)

    Reports of the required health examinations and tests.

    (3)

    Person to contact in an emergency.

    (4)

    Position and date of employment.

    (d)

    Medication records. When prescription medication is to be dispensed by the child care facility, the name of the doctor, child and medication directions for administering shall be written on the label. A written request signed by the parent shall accompany the medication stating the time and amount of dosage and the name of the medication to be given the child. The child care facility shall record the name of the child, medication, date, time and amount of dosage dispensed. This record shall be initiated by the adult who dispensed the medication.

    (e)

    Other records.

    (1)

    Unusual incidents and accidents. A written record of unusual incidents affecting the program of the facility as well as accidental injuries to children, employees or volunteers must be kept on file.

    (2)

    Fire drills. A written record must be kept of each monthly fire drill showing date, number of children in attendance and time taken to evacuate the premises.

    (3)

    Menus. Records of menus served shall be placed on file and kept for a minimum of one month.
