§ 18-26. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Adult means a person 18 years of age or older.

    Child means a person less than 18 years of age.

    Child care means the care, protection and supervision of a child for a period of less than 24 hours a day on a regular basis which supplements for the child, in accordance with his individual needs, daily care, enrichment opportunities and health supervision, and where a payment, fee or grant is made for care.

    Child care facility includes any child care center or child care arrangement that provides child care for more than five children unrelated to the operator and which receives a payment, fee or grant for any of the children receiving care wherever operated, and whether or not operated for profit. The following are not included: Public schools and nonpublic schools which are in compliance with the compulsory school attendance law, F.S. ch. 232; summer camps having children in full-time residence; summer day camps; and Bible schools normally conducted during vacation periods.

    Department means the department of health and rehabilitative services.

    Division means the division of family services, department of health and rehabilitative services.

    First aid training refers to successful completion or current enrollment in a course of instruction designed to provide fundamental principles and knowledge of and skills in first aid and accident prevention, equivalent to the Red Cross Standard First-Aid Multimedia Course.

    Handicapped child means a mentally retarded, hard of hearing, deaf, speech impaired, visually handicapped, seriously emotionally disturbed, crippled or otherwise health impaired child who by reason thereof requires special services.

    Infant means a child less than 24 months of age.

    Local licensing agency or county health department means the Gadsden County Health Department.

    Operator means any person ultimately responsible for the overall operation and administration of a child care facility, whether or not he is the owner.

    Owner means the person who bears legal ownership of the property.

    Parent means the child's parent or guardian or custodian.

    Secretary means the secretary of the department of health and rehabilitative services.

    Staff means any person, including an operator, whose duties are related to the care, protection and supervision of children in a child care facility.

    Substitute means any person providing care for children in the absence of regular staff.

    Summer day camp means summer day camps which operate on grounds other than that operated as a child care facility.

    Usable space means that space available for indoor play space, excluding permanent fixtures. In indoor areas, usable space is calculated by deleting space for stairways, toilet and bath facilities, permanent fixtures and nonmovable furniture.
